Confirmation means written confirmation by Explore Life of your request to hire Equipment;
Incident means an accident, loss or damage involving the Equipment;
Hire means your use of the Equipment on these Terms;
Hire Fee is the fee for the Hire Period specified in the Confirmation;
Hire Period means the period specified in the Confirmation;
Site means the location where the Equipment is set up;
Terms means these terms of hire;
You means the person named in the Confirmation.
2.1 You may request a Hire by following the process on Explore Life’s website (or other website through which you found out about Explore Life). Your Hire request is subject to Confirmation. Your Hire request constitutes your acceptance of these Terms.
2.2 You must pay a deposit of the Hire Fee on receipt of Confirmation. If you cancel your Hire request after receiving Confirmation and within 60 days before the start of the Hire Period, the deposit will not be refunded. If you cancel your Hire request or do not allow the Equipment to be set up at the start of the Hire Period, the full Hire Fee is payable.
2.3 Any alteration to your Hire request after you have received Confirmation will be subject to Explore Life’s approval, the availability of Equipment and any additional Hire Fee.
2.4 Explore Life may alter the Equipment before the start of the Hire Period, provided the alteration does not adversely affect your ability to enjoy the use of the Equipment.
2.5 Explore Life may increase the Hire Fee if unexpected additional work is needed to set up the Equipment at the Site.
2.6 You confirm that all information supplied to Explore Life in connection with the Hire is true and accurate.
3.1 The balance of the Hire Fee (after payment of the deposit) is payable in full before access is given to the Site or the Equipment is set up.
3.2 The Hire Fee does not include GST, which must be paid at the same time the Hire Fee is paid.
3.3 Explore Life may retain your credit card details for up to 6 months after the end of the Hire Period. Explore Life may debit your credit card for all additional costs incurred in relation to the Equipment during the Hire Period.
4.1 You must check in by the time specified in the Confirmation. No refund of the Hire Fee will be given for late check-in. You may also be denied access to the Site if you arrive outside Explore Life’s working hours.
4.2 You are responsible for the conduct of all members of your group who access the Site or use the Equipment.
4.3 Explore Life may refuse access to the Site to any person who causes damage, disruption or nuisance, or who is an unaccompanied minor.
4.4 You must not:
4.5 No barbecue, gas cooker or other device with a naked flame must be used inside any area of the Equipment or anywhere near the Equipment.
4.6 Glass is only permitted on the Site if the Equipment is being used by one or two people. Glass is not permitted during public events at which the Equipment is used.
4.7 Smoking and animals are not permitted on the Site or near the Equipment; otherwise, you may be required to pay the fee referred to in clause 6.4.
4.8 Explore Life may inspect the Equipment and Site at any time during the Hire Period.
5.1 If an Incident occurs, you must notify Explore Life as soon as practicable
5.2 Replacement Equipment is not guaranteed and is subject to availability.
5.3 If an Incident occurs, you will be responsible for the cost of repairing or replacing the Equipment.
6.1 You must vacate the Site or make the Equipment available for collection by the time specified in the Confirmation.
6.2 No refund of the Hire Fee will be given for vacating the Site early. Failure to vacate the Site or to make the Equipment available for collection by the time specified in the Confirmation may result in you incurring further charges.
6.3 At the end of the Hire Period Explore Life will inspect the Site and Equipment for any damaged or missing items. Any damage or loss will be your responsibility.
6.4 Explore Life may charge you a cleaning fee of up to $250 per item of Equipment such as a tent that is not left in a clean and tidy condition.
7.1 Explore Life may terminate the Hire before the end of the Hire Period and re-take possession of the Equipment, if:
7.2 If the Hire is terminated, you will not be entitled to a refund of the Hire Fee.
Without affecting anything else in these Terms, you are liable for:
9.1 Except as expressly set out in these Terms and the Consumer Guarantees Act, Explore Life gives no warranties or representations in respect of the Equipment and any implied warranties or representations are excluded to the full extent permitted by law.
9.2 Explore Life is not liable for any loss:
9.3 This clause 9 will survive termination of the Hire.
10.1 Explore Life will collect personal information about you in connection with its business. This includes information necessary to protect or enforce Explore Life’s rights and information required by law.
10.2 Explore Life will not disclose your personal information without your permission and will not sell your personal information.
10.3 You can ask that your personal information be updated, corrected or deleted at any time.
10.4 Explore Life endeavours to protect your personal information but cannot guarantee the security of any information transmitted via email. Once Explore Life receives your transmission, Explore Life will endeavour to ensure its security.
11.1 Explore Life owns the Equipment. You must not sell, lend or part with possession of the Equipment.
11.2 Explore Life may revise these Terms by updating its website. Your continued use of the Equipment will constitute your acceptance of the revised Terms.
11.3 Any notice given under these Terms must be in writing by email and will be deemed to have been given on transmission. Notices to Explore Life or you are to be sent to the email address specified in the Confirmation.
11.4 You may not assign or transfer any of your rights or obligations under these Terms.
11.5 These Terms are governed by New Zealand law.
